Cyber crime is prosecuted by specialists and defended by generalists. That gap is where most cases are lost. Freezing orders, NCRP-linked complaints, payment-trail reconstruction and Section 63 BSA certification are technical areas, and a defence that treats them as ordinary cheating cases tends to lose ground early.
What this means
Cyber offences in India are prosecuted under a combination of the Information Technology Act, 2000 and the Bharatiya Nyaya Sanhita. The IT Act supplies offences like identity theft (Section 66C), cheating by personation using a computer (Section 66D), violation of privacy (Section 66E) and publishing obscene material (Section 67). The BNS supplies cheating, criminal breach of trust and forgery.
Delhi has a dedicated Cyber Crime cell in each district, plus the Special Cell. Complaints usually originate on the National Cyber Crime Reporting Portal at cybercrime.gov.in, which routes them to the jurisdictional unit.

If you have been accused
Being named in a cyber FIR frequently follows nothing more than having received money into your account from someone who turned out to be a fraudster. That is a defence, but it has to be built from documents — invoices, trade records, KYC, correspondence — not asserted.
Do not delete anything. Deletion is detectable, and it converts a defensible case into a bad one. Preserve devices, chat histories and email. Do not give a statement without counsel.
If you are the victim
Speed is the only variable you control. Call 1930 immediately and file at cybercrime.gov.in the same day. Write to your bank within three working days to protect your liability position under the RBI framework. Preserve the device without resetting it.
Portal complaints with no follow-through tend to sit. Where the amount justifies it, a written complaint to the jurisdictional cyber unit and, if needed, court proceedings push recovery along.
Digital evidence and Section 63 BSA
Electronic records require a certificate under Section 63 of the Bharatiya Sakshya Adhiniyam (formerly Section 65B of the Evidence Act) to be admissible. Defective or missing certification is a live defence point that is frequently overlooked — by both sides.

Can money lost to online fraud actually be recovered?
Sometimes, and the variable that matters most is how fast it was reported. Money moves through a chain of accounts and is withdrawn quickly. Reporting on 1930 within the first hours gives a real chance of the funds being held before withdrawal. After weeks, recovery becomes much harder.
The FIR was registered in another state. Do I have to travel there?
Usually not for the early stages. Anticipatory bail can be moved where you reside in many situations, and appearance before the investigating officer can often be arranged by video or through counsel. Cyber complaints are routinely registered in districts the accused has never visited.
What is a "digital arrest" scam?
Callers impersonating CBI, ED, TRAI or customs officers tell the victim a parcel or account is linked to a crime, keep them on a video call for hours, and extract money as "verification" or "bail". No agency arrests anyone over a video call. Disconnect and report on 1930.
