Special Marriage Act — the 30-day notice
- Notice of intended marriage filed with the Marriage Officer of a district where one party has resided for at least 30 days.
- The notice is published for 30 days, during which objections may be filed.
- If no valid objection, the marriage is solemnised before the Marriage Officer and three witnesses.
- The certificate is issued and is conclusive evidence of the marriage.
The publication requirement is what exposes couples marrying against family opposition. Courts have questioned it, and some High Courts have held that publication is not mandatory where the couple objects — but the position varies and should be checked at the time.
Hindu Marriage Act registration
Where the marriage has already taken place by ceremony, registration is administrative. Documents, witnesses and the appointment with the SDM office are usually completed within a few weeks. The Tatkal registration scheme in Delhi allows same-day registration in many cases.
