The Consumer Commissions are one of the few forums in India where an ordinary claim is decided in a reasonable time and without prohibitive cost. For the right kind of dispute they are far better than a civil suit.

What this means

The Consumer Protection Act, 2019 provides a three-tier structure: District Commission for claims up to ₹50 lakh, State Commission from ₹50 lakh to ₹2 crore, and the National Commission above that. Delhi has District Commissions across the districts and the State Commission at Vikas Bhawan.

What qualifies as a consumer complaint

  • Defective goods — manufacturing defects, goods not matching the description.
  • Deficiency in service — banking, insurance, telecom, travel, healthcare, education, real estate.
  • Unfair trade practice — misleading advertising, false representation.
  • Overcharging — above the displayed or MRP price.
  • E-commerce disputes — the 2019 Act and the E-Commerce Rules cover online platforms explicitly.

Note that a purchase for commercial resale is generally excluded, though goods bought for self-employment are covered.

Builder disputes

Delayed possession, deficient construction and false amenity claims are all actionable as deficiency in service. The Consumer Commissions have awarded refund with interest and compensation in large numbers of such cases. RERA is a parallel route and the choice between them turns on the specific facts and the project's registration status.

Insurance and banking claims

Repudiated insurance claims are among the most commonly successful consumer complaints, particularly where repudiation rests on a technical non-disclosure that had no bearing on the claim. Unauthorised bank transactions, wrongly levied charges and deficient service are similarly actionable.

Limitation

A complaint must be filed within two years of the cause of action. Delay can be condoned on sufficient cause but should not be relied upon.
